PER CURIAM.
The appellee having confessed error in the entry of the summary judgment for the defendant in the court below, it is therefore ordered and adjudged that the summary judgment dated September 8, 1975 be and the same is hereby set aside, and this matter is returned to the trial court for further proceedings.
