Abbott appealed to the Federal Circuit, which affirmed on July 1, 1999. 182 F. 3d 1315 (Fed.Cir.1999). Abbott’s petition for certiorari was denied on January 10, 2000. 528 U.S. 1078, 120 S.Ct. 796, 145 L.Ed.2d 671 (2000). The Agreements did not terminate on their own terms, however.
