We affirm based on the authority of Gencor Industries, Inc. v. Wausau Underwriters Insurance Co., 857 F.Supp. 1560 (M.D.Fla.1994), and Everest & Jennings, Inc. v. American Motorists Insurance Co., 23 F. 3d 226 (9th Cir.1994).
