1. From the main page https://acis.flcourts.gov/portal/home, click on the LOGIN / REGISTER link in the upper-right corner. 2. Click on the Sign up now link.

Florida Appellate Case Information System (ACIS) GATEKEEPER SECURITY AGREEMENT

Requests for Justice-Partner Organization accounts with the Florida Appellate Case Information System (ACIS) require the designation of a Gatekeeper using this Gatekeeper Security Agreement (Agreement) form to initiate the creation of an ACIS organization account. By signature, the Organization Head affirms that the contact and other information on this Agreement is correct.

The Organization Head must sign this agreement and have it notarized. By signing, the Organization Head affirms they will provide Gatekeeper oversight and ensure compliance of Gatekeeper's responsibilities as set forth below. Further, the ACIS Administrator should be immediately notified if the Organization's designated Gatekeeper terminates employment, to ensure that all active accounts are disabled.

By signing this Agreement, the Organization acknowledges the following:

1. USER ACCOUNTS AND PUBLIC RECORDS a. The appointed Gatekeeper and authorized users will have access to statewide appellate court records, based on the current version of the Florida Supreme Court Standards for Electronic Access to Court Records and the Access Security Matrix (Matrix). b. The appointed Gatekeeper will have responsibility for the management of assigned ACIS user accounts. c. Under Florida law some records are considered sensitive, confidential, and/or exempt from public disclosure, and may be deemed so at any time by Florida or Federal law, court rule, or court order. 2. GOVERNANCE & PENALTIES a. Electronic access to Florida court records is governed by the Matrix in the most current Administrative Order governing Electronic Access to Court Records. The access to ACIS records is limited to the corresponding Matrix security group for the Organization and respective role. Access to court records in ACIS may be more restrictive based on the local Clerk of Court's ability to provide the records online. Access to ACIS records is limited to the corresponding Matrix security group for the Organization role. b. Use of ACIS is subject to the Florida Computer Crimes Act (Chapter 815, Florida Statutes) which provides penalties for unauthorized use of information resources for all systems protected by the Act. c. ACIS User accounts may be inactivated when there is no activity within any consecutive 60-day period. d. The ACIS Administrator reserves the right to audit usage of the ACIS system on a periodic basis to ensure compliance with this Agreement. For security and analytic purposes, information about searches conducted within the ACIS may be logged, in an effort to maintain and improve provided services.

3. GATEKEEPER ADMINISTRATION a. The Gatekeeper will manage the eligible user accounts for the Organization, including adding and removing user access, and continual audits of user eligibility. b. The Gatekeeper will immediately remove any Organization user who has ceased to be an active or eligible user. c. The Gatekeeper will immediately notify the ACIS Administrator upon discovery of a password or other security breach, including the discovery that an assigned password is known by an unauthorized person or entity (whether used or not). d. The Gatekeeper will maintain the confidentiality and prevent the unauthorized disclosure of any records or information available to the Gatekeeper and accessed or obtained from ACIS that is confidential or exempt from public disclosure under Florida or Federal law, court rule, or court order. e. Gatekeepers will promptly report to the ACIS Administrator known or suspected theft, loss, or unauthorized disclosure of confidential or exempt information, to include user credentials. Reports may be submitted by calling (850)922-5517 or by sending an email to [email protected]. 4. LIMITS OF LIABILITY

a. Gatekeepers release the ACIS Administrator and its employees or agents from any liability or damages resulting from or related to: (a) interrupted ACIS service of any kind; (b) usage of the Gatekeeper's equipment; or (c) use or viewing of ACIS electronic court records. b. This Agreement, regardless of where actually accepted or delivered, is deemed to have been accepted and delivered by the parties in the State of Florida, and any dispute arising from it will be governed by Florida law. Any suit for any claim, breach, or dispute arising out of this Agreement will be maintained in Leon County, Florida.

5. DISCLAIMER: ACIS information is provided as a public service and is NOT an authoritative public record. 6. TERMINATION AND OTHER REMEDIES a. If the Gatekeeper breaches the provisions in this Agreement or otherwise uses ACIS data or information improperly, the ACIS Administrator may immediately terminate this Agreement and pursue any other available remedies. b. This Agreement will be terminated immediately if funding of ACIS is withdrawn for any reason. The Organization Head acknowledges that the ACIS Administrator has no control over legislative appropriations that may be provided by any governmental entity for the continuation of the services provided under this Agreement.

7. If any part of this Agreement is found to be invalid, then it will have no effect, but the remaining provisions will continue in full force and effect.
