GRETCHEN LEEPER, PERSONAL ADMINISTRATOR OF THE ESTATE OF JASON OWENS
v.
THE GEO GROUP, INC., SYLVIA HENRY AS PERSONAL REPRESENTATIVE OF THE ESTATE OF MARK HENRY, TONY STEWART AND JESSIE STRICKLAND

Fla. 1st DCA | 2020-01-29
No. 19-4546
Florida District Court of Appeal, First District (2020)

Opinion of the Court
Roberts

PER CURIAM.

To the extent that Petitioner seeks certiorari relief, the “petition for writ of certiorari or mandamus” is dismissed for lack of jurisdiction. See Landmark at Crescent Ridge LP v. Everest Financial, Inc., 219 So. 3d 218, 219 (Fla. 1st DCA 2017) (explaining that where the threshold jurisdictional requirement of irreparable harm is not shown, the petition for writ of certiorari should be dismissed for lack of jurisdiction). To the extent that Petitioner seeks mandamus relief, the petition is denied on the merits. See Holland v. Wainwright, 499 So. 2d 21 (Fla. 1st DCA 1986) (explaining that a petition for writ of mandamus must show failure to perform a ministerial duty). WOLF, B.L. THOMAS, and ROBERTS, JJ., concur. _____________________________
