DAVID J. BLEVINS
v.
STATE OF FLORIDA

Fla. 5th DCA | 2020-06-11
No. 19-3734
Florida District Court of Appeal, Fifth District (2020)

Opinion of the Court

PER CURIAM.

In this Anders1 appeal, we affirm David Blevins’ judgment and sentence. However, we remand for the trial court to strike the costs assessed pursuant to section 318.18(11)(b), Florida Statutes (2018), as Blevins was not charged with a traffic infraction. 1 Anders v. California, 386 U.S. 738 (1967).

See Sorenson v. State, 291 So. 3d 630, 630 (Fla. 5th DCA 2020). The lower court correctly ordered these costs be stricken. However, they remain in the subsequent amended costs order. AFFIRMED; REMANDED with instructions.
