Est. OF Barbara K. Heckert v. State, 731 So. 2d 47 (Fla. 3d DCA 1999)…On August 24, 1998, the trial court entered an order granting DOR’s motion for summary judgment and denying the estate’s motion. We agree with the estate that its position is consistent with this Court’s decision in Department of Revenue v. Good, 398 So. 2d 938 (Fla. 3d DCA 1981). Accordingly, on the authority of Good, we reverse the Final Summary Judgment entered on behalf of the State of Florida and remand with instructions to enter final summary judgment in favor of the estate.
